General terms and conditions
These general terms and conditions govern the relationships between members and/or clients of "Lizakain" EOOD. By clicking on an object, image, link (different from the General Terms and Conditions) or button located on the website: https://lizakain.com/, it is considered that you accept or agree with the General Terms and Conditions described below.
1.Definitions
LIZA KAIN – “Lizakain” EOOD, UIC 206868112, registered office: Sofia, 27 Gen. Yosif V. Gurko Str., represented by the manager Elizabeth Edward Kain, referred to for short as LIZA KAIN, telephone: 0876424032, e-mail: info@lizakain.com
Website – https://lizakain.com/, and their sub-domains, including but not limited to the public website
Partners – commercial companies with which LIZA KAIN has concluded contracts for the sale of discount coupons for the use of the services and/or products provided in the relevant retail outlets.
Coupon (Voucher) – a discount document issued by the partner and sold by LIZA KAIN through the website to members and/or customers, which is valid for the period specified therein and applies to the services and/or products specified therein.
Check - a discount document issued by LIZA KAIN, which is valid for the period specified therein, as a preference for loyal members.
The content has the following definition:
• All information on the Website that can be viewed using an electronic device;
• The content of all emails sent to USER and CLIENT by LIZA KAIN via electronic means and/or any other means of communication;
• Any other information to a USER or CLIENT received from a LIZA KAIN employee, regardless of the method of communication;
• Information related to products, services and/or fees applied by LIZA KAIN in a given period;
• Information related to products, services and/or fees applied by third parties with whom LIZA KAIN has an established partnership during a certain period;
• Information concerning LIZA KAIN or any information with a source LIZA KAIN.
Service – An electronic commercial service performed on the publicly accessible parts of the Website, with the aim of providing the customer with the opportunity to purchase products and/or services, including the purchase of coupons (vouchers), using only electronic means, including means of distance communication (e.g. standard letter, Internet, e-mail, etc.).
Member – an individual possessing or gaining access to the content, through any means of communication (electronic, telephone, etc.) or based on the use of an agreement between LIZA KAIN and third parties, which requires the creation and use of an account.
Profile – an element consisting of an e-mail address and password that allows only one member to access limited parts of the website and through which the services are accessible.
Customer – an individual who owns or gains access to the content or services after creating a membership account.
Document – these general terms and conditions.
Distance sales contract – any contract concluded on the basis of an offer from the supplier LIZA KAIN to the consumer as part of a system for the sale of goods or provision of services, including the purchase of vouchers (coupons), where from the date of the offer until the conclusion of the contract, the parties are not in physical contact with each other.
Brochure/notices/messages – currently informational means, mainly electronic, concerning products, services in the partners' retail outlets, including the purchase of vouchers (coupons), or promotions offered by LIZA KAIN in a certain period of time, without binding LIZA KAIN to the information provided.
Transaction – collection or refund of funds resulting from the sale of a product or service, including the service of purchasing vouchers (coupons), by LIZA KAIN to a client.
2. General applications
2.1. This document sets out the general terms and conditions under which a member or client may use the website/content/services, in the absence of any other valid agreement between LIZA KAIN and the member/client.
2.2. Use, including but not limited to accessing, visiting and viewing content/services, implies that the member or customer adheres to these General Terms and Conditions, except in cases where the given content has specific conditions mentioned.
2.3. Access to the services is possible only and exclusively through the publicly accessible websites https://lizakain.com/
2.4. By using the website/content/services, the member or client is solely responsible for all consequences arising from such use. In addition, the member or client is responsible for any property, intellectual or electronic or any other nature of damage caused to the website/content/services, LIZA KAIN or any other person with whom LIZA KAIN has concluded a contract for joint activity or for the provision of services according to Bulgarian law.
2.5. If the member or client does not agree and/or does not accept, and/or revokes their consent to this document:
2.5.1. He/She waives: access to services; other services that LIZA KAIN offers through its website; receipt of brochures/notices or other communication from LIZA KAIN (electronic, telephone, etc.) without any additional guarantee from LIZA KAIN.
2.5.2. LIZA KAIN will delete all personal information from its database without any subsequent obligations from one party to the other and without either party being liable for damages to the other.
2.5.3. May at any time change its decision to accept or reject this document, as it exists at the time of the decision.
2.6. The client/member may at any time agree and accept the document as it is available at that time.
2.7. To exercise the right described in Art. 2.5, the member/client may contact LIZA KAIN or use the internet links provided by LIZA KAIN for this purpose.
2.8. The Client may not withdraw his consent with retroactive effect to this document while a contractual relationship is in force or until he has paid all funds due under the contract to LIZA KAIN.
2.9. If the client has paid all due funds to LIZA KAIN and withdraws consent to this document at the time of placing an order, LIZA KAIN will terminate the order without incurring additional obligations and without either party being liable for any damages incurred.
2.10. The website is addressed only to members and customers who are duly registered and have not been rejected by LIZA KAIN, regardless of the reason. The possibility of ordering online is available only to members residing in Bulgaria. Persons under 18 years of age are not entitled to use the website/content/services, to make statements and to conclude contracts within the meaning of these general terms and conditions. By registering on the website and creating a profile, the person declares that he/she is of legal age (18 years or older).
3. Contents
3.1. All content, including, but not limited to, static images, dynamic images, text and/or multimedia content, published on the website are the property of LIZA KAIN or third parties, in which case the content may be accompanied by a mention of its ownership, for which LIZA KAIN has permission to use.
3.2. The member or client may not copy, transfer, modify or make other changes, use, link to, display, include any content in any context other than that of LIZA KAIN, including any content from the website outside of LIZA KAIN, removing images, trademarks, distribution of materials prepared for reproduction, modification or display of content, without the express consent of LIZA KAIN.
3.3. Any content to which a member or customer has or receives access is protected by the document, unless the content is accompanied by a specific and duly issued consent for use between LIZA KAIN and the member or customer or another party or there is no explicit mention by LIZA KAIN of the content in question for its use.
3.4. A member or customer may copy, transfer and/or use the content only for their own personal and non-commercial purposes, but only if they do not conflict with the provisions of the document.
3.5. If LIZA KAIN grants a member or client the right to use content, pursuant to a separate agreement to which the member or client has or acquires access, differing from that described in this document, the right extends only to the content defined in the agreement only as long as the content is available on the website or within the period agreed in the agreement according to the conditions mentioned in the agreement only in case it exists and does not constitute confidential information given by LIZA KAIN to the given member, client or other third parties who possess/acquire access to the transferred content in any way, which access may be withdrawn in any way during or after the expiration of the usage agreement.
3.6. No content transferred to a member or client through any communication channels (electronic, telephone, etc.) or acquired by a member or client through accessing, visiting or viewing it shall constitute the emergence of a contractual obligation for LIZA KAIN and/or the LIZA KAIN employee who has carried out the transfer of the content in cases where it is known and related to the given content.
3.7. Any use of the content for purposes other than those expressly mentioned in this document or in any accompanying document, if any, is prohibited.
4. Contact
4.1. LIZA KAIN publishes on the website its complete and accurate identification data, as well as its contact details on the part of a member or client.
4.2. By using the contact form provided on the website, the member or client allows LIZA KAIN to contact him/her through available means, including electronically.
4.3. Partial or complete completion of the contact form does not oblige LIZA KAIN to provide feedback to the member or client.
4.4. Access to the website, use of the information presented, visiting its pages or sending e-mail notifications addressed to LIZA KAIN is done electronically, by telephone or other means available to the member or client, which constitutes a presumption that the member or client agrees to receive notifications from LIZA KAIN electronically and/or by telephone, including e-mail communication or notifications on the website.
4.5. LIZA KAIN reserves the right not to respond to all requests of any kind, received in any way (email, telephone, etc.).
5. Brochures, notices and announcements
5.1. When a member or client creates a profile on the website, accepting the General Terms and Conditions, he/she also agrees by default to receive brochures and/or notifications from LIZA KAIN.
6. Card payment terms
When choosing a card payment method:
• A payment page of our servicing bank (UBB) opens, where you enter your card details (number, validity, security code, name);
• If you are registered in the Verified by VISA or MasterCard SecureCode authentication schemes, an authentication page of your issuing bank opens, where you enter your authentication password;
• Upon successful transaction (successful authentication and authorization), a transaction note is displayed on the screen, which you can print or save.
Please note that your V PAY or MasterCard Electronic card will only be accepted if it is registered for participation in the Verified by Visa or MasterCard SecureCode online authentication schemes.
"Lizacain" Ltd. makes every effort to provide reliable protection for its online store. To protect you from misuse when paying with your Visa or MasterCard card, we apply the best practices recommended by international card organizations:
• Security when entering and transferring card data is ensured by using SSL protocol to encrypt the connection between our server and the payment page of our servicing bank;
• The authenticity of your card is verified by entering a security code (CVV2);
• In addition, to identify you as a cardholder, the e-commerce payment server of our servicing bank supports the authentication schemes of international card organizations – Verified by VISA and MasterCard SecureCode, in case you are registered to use them.
If it is necessary to return amounts paid by card for services contracted and performed by us, this will be done by us through a credit transaction on the card with which the payment was made;
• The maximum transaction amount is 10,000 BGN;
• The transaction currency when paying by card is Bulgarian lev (BGN);
• Payment for goods and delivery is made through the following credit or debit cards: VISA, VISA Electron, V PAY, MasterCard, Maestro and MasterCard Electronic, as well as in cash upon delivery, if the customer has selected the relevant option and it is available for the relevant payment.
7. Payment terms for cash on delivery
The cash on delivery payment method requires an additional fee of 2.00 BGN, which you will have to pay upon delivery. This fee will be added to the total amount of your order automatically and is required by our courier.
8. Payment Data Protection Policy
"Lizacain" Ltd. makes every effort to provide reliable protection for its online store. To protect you from misuse when paying with your Visa or MasterCard card, we apply the best practices recommended by international card organizations:
